Terms of Sale

Thank you for visiting Red Elm Outfitters.  The following "Terms of Sale" govern your purchases on our site. This site is owned and operated by CIX Products Inc.  The terms below will refer to CIX Products Inc. as "CIX Products", "Red Elm", "Red Elm Outfitters", "we," "us," and "our."  And to the customer/potential customer as "buyer", "you" & "your".  All items in question will be referred to as "product".
 

YOUR ORDER
Upon placement of order, your product will be shipped from the closest available warehouse.  Every order is subject to these terms of sale and will conclude with the delivery of the product. Following completion of your order you will receive a confirmation page.  Please inform us any errors or changes in your order immediately following payment.

Tracking information is available and is not supplied unless requested.

We reserve the right to cancel any order.


PAYMENT
Payment will be credited to your card following shipment of product.  If for any reason we are unable to provide you with the product purchased, we will notify you before process of payment and will cancel the order upon your request. 


Price Discrepancies
The total price charged to your credit card will be displayed at the bottom of the final invoice/authorization page.  Any price you see otherwise is not the official price and will not be honored.  Please review your final invoice page carefully.

In the event of a price discrepancy please contact us through the "Contact Us" page with the item number and a description of the incident.


SHIPPING POLICIES AND DELIVERY

Shipping charges listed on our site apply to the contiguous US only.  Alaska, Hawaii, Puerto Rico, Guam, Virgin Islands and APO/FPO require a special handling fee of $10 plus actual shipping charges based on the weight and dimensions of the product or total product purchase.

International Shipping: By law, we are restricted from shipping all Night Vision, Thermal Vision, and specialized optics to addresses located outside the 50 United States.  

Express Shipping service is available upon request.  Please request expedited service through the "Contact Us" page on our site.  Express service must be agreed to before placement of payment otherwise orders not previously agreed to will ship with the service listed on the final invoice.

Delivery: Upon delivery of your order you will assume all responsibility for the security of the product.  Delivery is defined by the terms and conditions of the freight carrier so upon agreement of purchase you also agree to the terms and conditions of the freight carrier in question.  Possible freight carriers are: USPS, FedEx, UPS, DHL.  For complete terms and conditions regarding delivery terms please contact us through the "Contact Us" page on our site.

RETURN POLICY

Every product sold through Red Elm is backed by our satisfaction guarantee.  Returns are processed in accordance with the manufacturers guarantee and if determined that the product was used in accordance with the manufacturers recommendations a refund or replacement will be issued to the credit card used in the initial purchase.  Products must be returned within 30 days of purchase and must show no signs of misuse or abuse.  Returns must include all original parts, accessories, manuals, and packaging. 

Our return policy does not apply to the following:
 

CDs, Computer Software, Videos, Electronics, Tents, Waders, Tree Stands, Ice Houses, Perishables.

Items eligible for return should be sent to the address below.  Return packaging is the responsibility of the buyer so product damaged upon return will be refused or may be subject to additional charges:

LOW PRICE GUARANTEE
All prices quoted are MAP prices set forth by the manufacturer.  Competitors selling lower than our advertised pricing might be in violation of manufactures MAP pricing.  Please report any pricing advertised lower than our advertised price.


LIMITATION OF LIABILITY
Our liability will be limited as set forth in the Terms and Conditions. Nothing in these Terms of Sale limits liability for fraudulent misrepresentation or our liability to you in the event of death or personal injury resulting from our negligence. Some jurisdictions do not allow the exclusion of implied warranties, or certain kinds of limitations or exclusions of liability, so the limitations & exclusions set out in these Terms of Sale or the Terms and Conditions may not apply to you.


WARRANTIES AND DISCLAIMERS
Products sold by Red Elm Outfitters may be covered by manufacturers' warranties. Where applicable, warranty information should be included with your product. THERE ARE NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  BREACH OF A WARRANTY, IF ANY, IS LIMITED, IN Red Elm's DISCRETION, TO REPAIR OR REPLACEMENT OR RETURN OF THE PURCHASE PRICE OF A PRODUCT AS DESCRIBED IN THESE TERMS OF SALE, AND ALL CLAIMS FOR CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES ARE HEREBY EXCLUDED.


ASSIGNMENT
These Terms of Sale are personal to you and you may not assign or otherwise transfer any right or obligation under these Terms of Sale except as permitted herein. We reserve the right to transfer, assign, license or subcontract all or any of our rights or obligations under these Terms of Sale or any related contract to any third party.


FORCE MAJEURE
We will not have any liability to you or be deemed to be in breach of these Terms of Sale from any circumstances, which are beyond our reasonable control (including a delay in delivery caused by force majeure). "Force majeure" includes, without limitation, circumstances directly or indirectly resulting from acts of God; acts of the public enemy; strikes; lockouts; epidemic and riots; power failure; fire; earthquake; water shortage or adverse weather conditions; or other causes beyond the control of the Parties.


AMENDMENTS
We reserve the right to make changes to these Terms of Sale at any time. You will be subject to the Terms of Sale in force at the time you place your order with us, unless any change to these Terms of Sale is required to be made by law (in which case it will apply to any orders previously placed by you).
